    Jury clears Monticello policeman

    WHITE PLAINS - A federal jury in White Plains, on November 20, refused to award damages to a Long Island woman who claimed to have been assaulted, verbally abused and spit upon by a Monticello police officer on May 23, 1995.
    Doreen DeBole of Valley Stream was in the company of Fernando Rodriguez, who was arrested for Driving While Ability Impaired and other vehicular charges. DeBole herself was charged with permitting an unlicensed driver to operate a vehicle, a violation.
    DeBole's lawyer, Jon Dupee of Goshen, told The River Reporter that Dietz' long history of complaints would strengthen DeBole's case. However, U.S. District Court Judge Charles Brieant refused to allow Dupee to examine others who have sued the village over alleged actions by Dietz. On Dupee's list was James Tomlinson, who was injured in a fight with Dietz and other officers in the police station lobby two months after DeBole. Dietz and two others were suspended without pay for six weeks over that incident.
    Dupee said he is considering appealing.
    Police chief Michael Brennan has said Dietz "learned his lesson" after the Tomlinson incident. Dietz was recently promoted to detective and given a raise, despite objections of members of local minority community.
