THE LAST WILL AND TESTAMENT
of
ARTHUR HAROLD RUE
and
OPAL BROOKS RUE



THE LAST WILL AND TESTAMENT of ARTHUR HAROLD RUE and OPAL BROOKS RUE, his wife, residing at 11011 Hubbell, in the City of Livonia, County of Wayne, State of Michigan.

KNOW ALL MEN BY THESE PRESENTS, that we, ARTHUR HAROLD RUE and OPAL BROOKS FUE, being of legal age and of sound disposing mind and memory, do hereby make, publish and declare the following to be our joint and mutual LAST WILL AND TESTAMENT, in the manner and form following:

I
We hereby revoke any and all former wills and codicils by us at any time heretofore made.

II
We will and direct that the just debts and funeral expenses of us, or of either of us, be paid as soon as possible after our deaths respectively.

III
We hereby bequeath to our grand-daughters, the doll collection of the above named testatrix to be distributed to said legatees by alternate selection with the order of selection to be determined by lot.

IV
We hereby bequeath and reaffirm the following gifts to the Temporal Bone Bank Program for Ear Research, University of Michigan:

We do hereby direct that immediately following our death, our temporal bones (middle and inner ear portions, including the hearing nerve and its central pathways) be removed without cosmetic disturbance or expense to our estate, and given to the Temporal Bone Bank Program for Ear Research, University of Michigan, for the purpose of dissection or microscopic examination to determine the nature, causes, and cures of ear disease and deafness. This gift is to take effect immediately upon our deaths.

V
Subject to the above and preceding specific bequests we bequeath and devise to the survivor of us, any and all property, real, personal, or mixed, owned by either of us at the time of the death of either of us, to the Survivor of us.

VI
After the decease of both of us, it is our will and the will of each of us, and we, and each of us, do and does direct that all the estate that we, or either of us, shall own have an interest in, or be entitled to at the time of our death, or the death of the survivor of us, both real and personal and mixed of whatsoever kind and nature and wherever the same may be situate, shall go and be paid over, delivered, transferred, and conveyed to our children: WILLIAM A. RUE, CLYDE B. RUE, ROBERT N. RUE, and JAMES A. RUE, in equal shares, share and share alike.

VII
In the event that any of our children shall predecease us or either of us, it is our will, and the will of each of us and we and each of us do and does direct that all ,that share in our estate to which said child or children would have been entitled to at the time of our death, or the death of the survivor of us, be paid over, delivered, transferred, and conveyed in equal shares to all the lawful issue of their body then surviving. Should one or more of our aforementioned children predecease us or either of us, leaving no lawful issue of their body surviving, it is our will and the will of us and each of us, and each of us do and does direct that such share to which said child would have been entitled, be paid over, delivered, transferred, and conveyed to the survivors or survivor of the aforementioned children, in equal shares, share and share alike.

VIII
We, and each of us, do hereby nominate and appoint ROBERT N. RUE as Executor of this our LAST WILL AND TESTAMENT, and request that he be required to execute no bond except such nominal bond as shall be required by law; and we and each of us, do and does authorize said executor to sell, transfer, grant, convey, exchange, lease, mortgage, pledge, or otherwise encumber or dispose of, any or all of the real or personal or mixed property of our estate, on such terms and conditions, and for such consideration, as he or she deems for the best interest c our estate.
IX
We, ARTHUR HAROLD RUE and OPAL BROOKS RUE, his wife, hereby agree, each of us with the other, to abide by the joint and mutual will as herein made, and not to make any will or codicil different than this, before or after the death of either one of us.

IN WITNESS WHEREOF, we have executed instrument, consisting of eleven provisions and contained on three pages, each page of which is signed by us, a for our LAST WILL AND TESTAMENT, this 10th day of June, 1970.

On this 10th day of June, 1970, ARTHUR HAROLD RUE and OPAL ROOKS RUE, the above named testators, signed the foregoing instrument, consisting of three pages, in our presence, and signed in our presence, each page thereof, and at the same time declared it to be their LAST WILL AND TESTAMENT, and we do now, at their request and in the presence of each other, hereto.

I, ROBERT N. RUE that I reside in the City of East Lyme, Connecticut and am interested in said estate and make this petition as Executor and son of said deceased whose Social Security Number is 370-22-1789.

I further represent that said deceased departed this life on the 12th day of March A.D. 1979, at the age of 69 years, leaving a/an Last Will and Testament, bearming date June 10, 1970 wherein Winston A. Wheaton, Carol Bassett and Sharon Yukas are the subscribing witnesses.
